Can common sense prevail in the Kentucky clerk of Court case?

CNN is reporting that a U.S. District Court Judge has issued a bench warrant for the Kentucky Clerk who refuses to issue marriage licenses to same sex couples on the basis of her sincerely held religious beliefs. This is a terrible decision–one that negatively alters the trajectory of society’s discussion of how religious liberty intersects with governmental authority.

There were other options open to the judge as well as to the parties to the case. That arrest was the decided outcome has, at least in my opinion, just set this discussion back a couple of years.
